   It happened on private property. Tenant called the driver over, tenant is responsible for damages. Tenant may or may not be able to recoup losses from the driver.
   
   Case in point, true story. My tenant Lori called Servigas to deliver propane. Driver backed into my gate. Lori had to (and did) pay me for the gate.
