What do I do about a guy that won't pay or return something?

    I put an intake up on Ebay a month ago, and I had this guy beg me to end the auction early so he could get his car running ASAP. Everything seemed fine, he said he was sending out the check on a Wednesday. That Friday, I found out I had to leave town for work. I had to leave the next day, and I would be gone for a week. Since I knew the check wasn't going to arrive before I left, I went ahead and sent the manifold out before I left. I wanted him to have it so he could get his car running, and I am a little too trusting sometimes.

    So, I get back from my trip, and there is no check. I give it a day or two to find out what's up, and I can't get ahold of him. Finally he calls me back, and says that the manifold had a repaired spot on it, and the threads were stripped for the distributor hold down. I said sorry, I didn't know they were there, because the manifold was painted and I didn't see it. He says "my mechanic said it is going to cost $150 to fix, are you going to take that off?" I said no, just send it back. It just wasn't worth it to me, I'd rather just eat the shipping costs. He got a pissy tone with me like I lied about the bad parts and tried to con him, and he never sent a dime to me in the first place!

    I haven't heard from him since. It's been about three weeks since I talked to him. I've left messages to no avail. What should I do? I know I don't have any protection from eBay since I ended it early. Is it considered Postal Fraud? Anyone know a Joe Weber from Sparrowbush, NY?

    Sorry for the rant, I've never been burned quite this bad before.

    i'm about 99% sure it is Postal Fraud. the government does'n take too kindly to that. i'd leave him a message saying that you are going to notify the USPS that he has commited Postal Fraud and see if that shakes his wallet lose... you did offer to take it back and eat the shipping costs so he is out nothing... and there is no way it should cost $150 to retap a friggin hole.

    To install the helicoil and to clean up the spot that is supposed to be welded. I honestly didn't notice it, but since it was painted I don't doubt it. I include some carbs, and stated two were missing some parts in my eBay ad, and he accused me of neglecting to mention that too.

    Maybe he's a nice guy that is in the hospital right now and not accessible to a phone, I don't know. I'd think 3 weeks is plenty of time to get ahold of someone regardless.


    I think I'll ask the Post Office about this, and see what they say. I have my receipt and the insurance receipt, and ticket stubs for my plane flight when I left if that helps any.

    I'm too nice of a guy. Ask anyone that knows me. He seemed straight when I talked to him on the phone. We talked about car stuff for a while. He said he had a 32 with an Ardun and a Barris Merc and an RPU he's had for years that he was re-doing. It didn't sound like bullshit at all. In retrospect, it seems like were outlandish lies, but I'm usually good at detecting posers and he seemed legit.

    I had to leave for Japan in less than 24 hours, so I didn't want him to be left without the manifold to get his RPU going. Otherwise, it would have been at least another week before I could send it. Maybe the HAMB has spoiled me, but I thought that guys into this stuff were pretty good people.

    definitley threaten mail fraud charges. i had purchased a reel to reel off of ebay, much like you sold yours. got lots of run around. finally threatened and got all sorts of emails back asking how i wanted to do it. i said ship it and finally it ended up the kids band was going on tour. i DID have to go into manhatten to get it but finally got it. turns out he didn't ship it because "you got it so cheap i wouldn't have made any money if i shipped it." asshole.

    I believe eBay has their own fraud system in place. You have to wait "X" amount of time before you can file your claim, so in the meantime just keep sending this guy emails and each time send a copy to yourself as well, that way everything is dated and shows you've been attempting to reach him. Contact eBay via their website and get the ball rolling. I ordered some books for my girlfriend and the credit card went through, but no books ever showed up. Eventually eBay credited my account, it just took months. Good luck!

    damn right. i wish he lived in my neighborhood. i'd get Mongo and the boys around and we'd pay him a little visit.. that actually sounds like fun... i garauntee he'd pay if these ugly mugs showed up on his door step.

    Actually, this sad story was $425 plus shipping.

    I do plan on going to Hershey this year, NY isn't too far......

    I'd let the SOB know you're contacting your lawyer and the postal service, cuz you need to do both and get this guy busted ASAP.

    You might check into putting a mechanics lien or other type lien on his house. Hopefully he doesn't live in a trailer.

    man sorry to hear about this shit.i know this is a little late and maybe piss some n.y ers off,but with my personal experince all n.y.ers are fuckin shady.i got burned so many times i stop shipping there all together.theres just to many people up to no good cramed into a little city.

    Man that sucks. I know hindsite is 20/20, but I never front anybody more than I'm prepared to lose. The guy sounds like a scumbag, and me personally I'd assume that I'm not going to get any money back from him. Probably smoked the intake, so to speak. That said, I would seek my pound of flesh through contacting the attorney general, postal inspector, police dept, AND I'd sue him in small claims court locally. I'm not sure, but at least in LA the sheriff will deliver the court summons personally for a small extra fee. I don't know if you can arrange that since hee's not in the same state, but worth a shot. Ebay usually sides with the buyer in transaction disputes (that's a whole nother topic), and since you sold it out of ebay i'm sure you're not covered anyway.
    It would be great to go kick the guy's ass, but then he'd just sue ya and take your house or something. I'd pursue those avenues until I was tired of it and got it out of my system, not expecting to get money back.

    Uhhh, if I read the original post correctly, he ended the auction early, so Ebay isn't going to want to know squat.

    Sparrowbush, NY is about half-way between NYC & Scranton, PA. Wrong end of the state for me to be of any help.

    I force myself to follow some rules learned the hard way......
    1. If I'm helping someone they have to show up in person.
    2. If I'm fixing their car I show up in mine, work on theirs at their place, install their parts they bought and provided and reciepted.
    3. And use their tools/shop/materials.
    4. Never lend or advance what you can't bear to part with.

    The story about the part needing repairs that offsets all costs incurred ranks right up there with I stole it because almighty god left it on your property by mistake kind of story, and no you won't get the part back, if you drive out the guy won't be there, with cover story ie grandma's funeral etc..

    I got burned for over $200 from a russian dude in NY. He disputed the paypal transaction and claimed his yahoo, ebay, and paypal accounts all got hacked. Naturally paypal did nothing for me, but I was able to threaten him enough with the stuff I mentioned in my prior post that he coughed up the dough. :)

    When the ruskie won the auction I smelled a rat, but thought maybe i was just stereotyping and he had good feedback. My mistake. Shoulda listened to my gut.

    Also send him a certified {registered] letter so you have proof you contacted the dude. Tell the guy to return it within X~amount of days or you will take legal action......... good luck

    I might be missing something, but what does the post office have to do with any of this. It seems like a small claims court thing to me. You would sue the guy for the money owed or the return of the property. The only thing the post office had to do with it was they happened to ship it to him.

    Keep calling, daily, from differant numbers.....people act alot differant when you catch em on the phone, instead of just leaving messages.

    Or buy a 250 plane ticket.

    I have to head to Rochester to pick up parts from RustyNewYorker in a couple weeks. If it isn't settled by then, I'll take the long way and pay him a visit.
