    Same in Massachusetts, the plates belong to the owner. I sell a car, I keep the plates, I cancel the registration, I cancel the insurance. The buyer has to register the car to get his own plates.

    As for those states where the plates stay with the car... they are so fucking stupid.....
     
  2. in Minnesota the plates stay with the car, but when i sell a car i insist we meet at the DMV and do the transfer

    we can also report the sale online to the state

  5. I've been down this freakin' road before courtesy of Evil Bay!

    Several years ago I listed a pair of Harley 45" tanks. One tank was near N.O.S. while the other (oil) tank needed metal work in the valley due to a quarter size hole and some dents. I took extremely clear pictures that were so clear you could see every pit and how deep it was. I also did a very precise and detailed description of what would be involved and that it would take an "experienced" metal man.

    The item sold at way under what I could have gotten at a bike swapmeet but I was fine with that. 3-1/2 months later this guy starts emailing me, mother fuckering me and said that I screwed him and wanted me to take the tanks back.

    I no longer sell bike parts anywhere on the internet.

    Just to clear up the Ohio title procedure. Both buyer & seller go before a Notary Public with 'sellers' title. Both sign 'sellers title', state mileage, & price of sale. Notary public puts embossed stamp and date on title. Buyer then takes this 'notorized' title to BMV, at which time he pays sales tax on stated price, and is issued a new title in 'his' name. This is now the only title for this car, and is in the new 'buyers' name.
     
  7. I'm sorry but to me that is "so fucking stupid" and a waste of a plate and tabs if you don't buy another car. Once you fill out the paper work on the title, including the report of sale, which I filled out including your drivers license number. Then I submit it, you own it whether you transfer the title or not, its out of my name.

    I also live in Ohio and about 15 years ago I sold a guy a '66 Ford. 3 weeks later the guy calls me and does the same thing he is doing to you.

    Anyways, to make it short. He sued me in court and because he could prove the car had FRAME DAMAGE (I didn't know) I had to repay him. The frame had rusted out right above the axle.

    In OHIO it is not legal to sell a car with frame damage for anything but a parts car.

    Them old Fords are known for frame rust. I learned this the hard way.

    Ohio title, my name, tagged, insured as I drove it all the time, bill of sale, just a added bonus, it was mine, no title jumping or anything wierd. All was disclosed that I knew, could I have missed something, sure, but if I never saw it, can't tell you about it...

  11. Old cars rust, especially where they use road salt. That's why you write "AS-IS" on the bill of sale. Can't believe that doesn't superceed any other rules. As I said before, buyer's job to inspect the frame of the car. Seller should be honest, but hell if you're driving it every day and nothing's wrong you may not notice a little hole or two starting under there.

    New York may be an anal state, but it's simple on the old cars. No titles, easy to get paperwork if you have to, you can register about anything you want. When it's sold, that's what. And I keep the plates.

    Had this happen years ago--sold a nice 57 Chevy to a guy who worked where I did--didn't even have the car for sale, he bugged me about it for 2-3 months. Finally sold it to him and about 2 weeks later he wanted his money back cause his wife didn't like it!! Didn't have to but gave him his money back ( money was very tight at the time) a friend then bought it and his wife drove it to work for years-takes all kinds.

    Makes ya wonder why so many old cars are getting hauled to the crusher, instead of being offered for sale. My own experience happened years ago. Building a 67 OT 4x4 Ford short box pickup. Frame up rebuild, had it to the point of being drivable, everything was jammed out, just needed finish bodywork and painting. Drove it to work one day and a guy had to have it. We made a deal, I had 2 months to finish it. He gave me a Buick estate wagon as a down payment, with a catch. It was sitting on the street with a tow away sticker, and had to be moved that night. After dumping 6 quarts of tranny fluid in it I drove it home. Finished the truck on time. He comes to check it out and pay me. Comes back from his test drive and says "truck doesn't have power steering" My Wife can't drive that. Power steering wasn't even offered from the factory on that truck. Then he wants me to pay him for the Buick. I happened to be crushing cars at the time. Sent him pictures of his flattened Buick. Never heard no more.

    Around here..."As-is, present state and condition, no warranty expressed or implied" is considered as being a done deal no matter what the car turns out to be.

    IT'S NOT a done deal.

    A Judge will look at the value of a GOOD car of the same model and year, consider if you bought the car as a driver or parts vehicle...then decide if the amount you paid reflected the value of a parts vehicle or a driver.
    Basicly, if you paid a price that reflects driver quality but due to undisclosed safety related issues it wasn't...the Judge can rule that the seller misrepresented the vehicle and award money back to the buyer or reverse the transaction completely.
    If suitable to both parties, the Judge MAY allow the seller to repair/have repaired the vehicle to roadworthy condition, based on a DOT inspection. (Safety, structure and drivability...not cosmetic stuff)

    Seen it happen with a Camaro a friend bought that ended up unable to pass the required inspection.
    We all thought he was screwed. NOT SO!

    He kept the car but was rewarded a $600.00 price adjustment to get the car repaired.

    I am a Notary in State of Ohio. If it was Notorized into his name, it is his. Never sign a Ohio Title, unless it is notorized out of your name. I tell people this all the time, better to be safe than sorry.
    If he gets it home, and decides to drive it, and wrecks it, and kills someone, they will say, he was trying it out, and he doesn't have the title. Someone like this will pull anything. His Insurance should pay for it, but what if he has his Liscense cancelled, Insurance doesn't cover people with no Drivers Liscense.
    I would tell him that your neighbor is a on Sheriffs Dept. & I told him about being threaten. If you have his phone # , give it to the Law, and let them trace it.
    You also have them sign a statment saying, it is sold without warranty, as it is.

    No "safety" inspection in State of Ohio....Ohio has no private sales lemon laws, or implied warranty unless spelled out, otherwise, as is, where is....

    I can't believe that you received some advise to give the Douche his money back. He inspected it, drove it and bought it. Its his car plain and simple. If I were you I would notify the police of the threats. It needs to be on record.

    I once bought a car I actually hated. Never thought to ask for my money back, I just sold it.

    My uncle told me that when he sells old cars or nice hot rods to tell the buyer that once it leaves this property it's yours! He tells them this. "I never want to see it again. I don't care if you only make a block away and the engine falls out of the car on to the pavment. I don't ever want to hear about it. It's as is, No warranty!

    People still buy his cars. To my knowledge he's never had a person come back to complain either.
     
  28. I took 2 to the crusher in the last 4 years. Probably wound up on the plus side of things compared to the d-bags you encounter when selling an old car. These were 1984 and 1997 vintage running, registered & inspected cars.

    i don't think i would do this, it might make him even more mad. nobody wants to get a box of someone elses dump in the mail. in fact most people don't like seeing their own dump any more than necessary. especially so close to christmas.... you might have to use a liner or something to help seal the box to prevent leakage though.:eek:

    I notice comments about sons of anarchy. I see the same thing down here in new zealand. I have lost count of how many people I have seen dressing up and trying to look tough while wearing sons of anarchy shirts. Its a tv show for crying out loud.
