  1. im not mad. This board is very diverse and that is to be expected with a post like this.
     
  2. on the ticket it is modified exhaust. Says nothing about the spark plugs.

    the pink/white chevy. My stupid brother grizz let his dad hold onto it for him out in tracy or something like that. It's sitting in a feild falling apart. Pisses me off. Things got a 350 in it. 4 wheel disc. drop spindles. freaking dope. Lazy bastard. so you probably won't see that car ever again...at least not the way it was. he won't sell it to me.

    Yeah..i had a "tuner" car..a 97 civic coupe. Not rice. But fast and fun. I still have one. a 2004 wrx wagon. But I've always loved classics. I used to get hassled by the cops all the time over there. Shoot I got popped in scotts valley once. My sister used to live there...she was going to bethany.

    If he didn't note the plugs in the exhaust just pull them out. What was the citation number he gave you?

    Get your car db tested. Bring it. You might get off. I'm sure I'll be dealing with the man on exhaust on both my cars in the next month. Be running glasspacks on the cadi and 3 inch on my wrx. booo.

    I agree, it will also cost you the time you have to take off to go to court. The noise thing you can probably beat, the spark plugs you probably won't.
    Pay it and move on.

  10. but there is nothing on the ticket about the plugs being there. So its not even part of the damn ticket he wrote. So when i go yto court that has nothing to do with the ticket at all. THats why im so annoyed. He said it was modified and the part that he pointed out being different was the plugs, which he didnt write me up for.

    maybe he didn;t write you up so you would understand to take em out before court. Your exhaust IS modified. It has glasspacks. So before court ya may want to take the plugs out before they bust your ass for that DURING court when they decide to look at your car.

    It wouldn't hurt to get a copy of the Cal. Vechicle Code and read up on the subject, so it doesn't look like you're pulling opinions out of the air in front of the judge. Your local JC should have a copy in the book store. It does sound like a good case to go fight though. I'm not sorry that I moved out of California although I sometimes think that is exactly what they want you to do. Also, I think that the rudeness of the general population rubs off and gets on the police like a disease. Tell me you were't just a little rude to the cop; I think you were.

    My daddy always told me that if I got a ticket for something I should always pay it right away. He said that even if I might not have had it coming at that time, I should think of all the times I should have gotten a ticket and didn"t. Would you rather pay the modified exhaust this time around or maybe a DUI that you got away with once (or more times)?

    Grow up, your exhaust is modified. Pay the damned ticket and be thankfull that is the one they got you on. You might be able to beat this one but what will the next one they get you for be? Your setting up bad carma, bad carma always get more then even. Gene

    MODIFIED exhaust? What year is the car in question? Im guessing its old. Would they like it better if you left whatever exhaust that was on the car originally? Im sure the original exhaust was just mint, NOT. What are the chances that you can buy an exact original exhaust pipe and muffler kit for the car? Little to none im guessing. So doing ANYTHING would be "modifying" the exhaust, wouldnt it?

    and like you said, it has to be SOUND modifying. Do the spark plugs change the sound? NO

    If you can get ticketed for merely modifying your exhaust, we should all be deep in debt by now

    This is ridiculous, and REALLY pisses me off. Pretty much ruined my night. I wish I wouldnt have even read this thread..................

    "27151. (a) No person shall modify the exhaust system of a motor vehicle in a manner which will amplify or increase the noise emitted by the motor of the vehicle so that the vehicle is not in compliance with the provisions of Section 27150 or exceeds the noise limits established for the type of vehicle in Article 2.5 (commencing with Section 27200). No person shall operate a motor vehicle with an exhaust system so modified.

    (b) For the purposes of exhaust systems installed on motor vehicles with a manufacturer's gross vehicle weight rating of less than 6,000 pounds, other than motorcycles, a sound level of 95 dbA or less, when tested in accordance with Society of Automotive Engineers Standard J1169 May 1998, complies with this section. Motor vehicle exhaust systems or parts thereof include, but are not limited to, nonoriginal exhaust equipment.

    I got one a few years ago.... didn't try fightin it. Had um right it off after supposedly fixing it and paid 90 bucs.... Same conversation went on.... he said "modified exhause" I told um to have a look.... then he said "well its too loud for me" I never did decide to fight it.... this was in the city of Orange.... Way I see it.... I gotta drive through there again.... n I could take the ticket n smile and hopefully next time he won't see me n write me up for anything else.... But remember he is Johnny Law and the judge is probably gonna side with him.... Oh yeah even if it isn't on the ticket he might decide to mention the plugs and you might get an asshole of a judge.... or you could just pay the 90bucs

    Dude, even if you win, you lose.

    Court fee is gonna be a minimum of 30-40 bucks, and you'll lose pay from work to show up. And there's no guarantee you'll win. I've seen plenty of court cases like this (I'm a law student, my boss is a local municipal judge), you stand a 50/50 chance.

    Even if your car does pass for volume and comes under the allotted 95 dBs, it is still louder than factory equipment and therefore in violation of the law. They can't get you on the flamethrowers because they are only for off-road use and unless you get caught using them on the street or in an area where police have jurisdiction, they aren't illegal (though police won't take kindly to you having them). If they busted you for the spark plugs while not using the flamethrowers, by the same reasoning they could bust someone for having one of those Pep Boys chrome exhaust tips.

    My car sets off car alarms, but I know that I'm vulnerable to tickets such as this. My neighbors have voiced their opinion of my exhaust, some favorable and some not. However, if they ever called the police on me, I'd simply as my neighbor for the building permit for his deck.

    How much is the ticket for? It's not a moving violation and doesn't carry any points. If it's for over $125, fight it. If not, suck it up and pay it.

    FWIW, when you are rude to the cop you make him look at all of us with a jaundiced eye. For the last twelve years I've driven cars so low that I'd be pulled over all time, if this were the fifties or sixties. A few with a real snappy exhaust note too. Blue dots? Usually no prob. That is now. In the old days we were hassled for everything. Now is much better, believe me. Unless you want to bring back the days of the cops always on our shit, be accomodating and nice when you deal with them. In the old days we changed tires for old ladies and picked up trash to try to get the cops off our asses. Well, we Barons didn't, but the other clubs in the AV did.

    I guess we're lucky around these parts, I have no mufflers at all. Straight pipe all the way out the Bellflowers and man is is she sweet!

    The cops around here never fuck with old cars. Most of them don't even have titles or plates.

    Check your State DMV laws. Check prior cases. If need be, comply with law before driving car to court. Ask to speak to the Officer before trial. Don't argue. Hopefully the two of you can come to some kind of agreement.
    If you need to go to trial, know your State law. If you don't, the Judge will read it for you. Once again, don't argue. Hopefully the fine won't be too bad.

    I wish there was a way we (the public at large) could arbitrarily hand some fuck cop a slip of paper that would cause him to waste his time and money fucking with it.

    Judges should FUCKING FIRE any cop, right there on the spot, that brings this kind of shit into our already over-crowded court system.

    My story....
    I was driving back from Houston to Austin in my old 94 z24. Car's in good shape, black, legally tinted window, shaved but everything else stock (including exhaust). Doing the speed limit (65) or slower cuz I'm looking for a cd. 2 trucks (Navigator and Suburban) speed past me on either side as we go over a hill. DPS is sitting in the median and pulls out.
    Guess who gets pulled over?
    "I pulled you over for doing 85 in a 65."
    (20 over seems to be the magic number with these dumb asses)
    "No I wasn't."
    "I'm sorry, what did you say?"
    "I wasn't-you sure it wasn't the 2 trucks that just sped past me?"
    "I've been an officer for (insert long time here) and I know when someone's speeding"
    "You clocked me with a doppler?"
    "I clocked you with a radar"
    "gun or stationary?"
    ..anyway, he gives me the ticket, telling me that the side of the road isn't a court. So I go, he shows up and does his 'I've been an officer for a long time' song and dance. I bring up the fact that doppler hits the largest moving object(like, I don't know, a fucking NAVIGATOR!) and the judge says, quote..
    "I've driven back from Houston many times. I know how people 'move with the pack' to avoid tickets. You just happened to be the one in the back. It was just your unlucky day."
    It wasn't my 'unlucky day'-it was a crooked ass system that flys in the face of anything resembling justice.
    So my hatred for authority figures was once again justified...
    moral of the story:
    They can do whatever the hell they want and don't have to give you the reach around.
    Just smile and think of a happy place when you grab your ankles, dude...
